â€Å"A judge's ruling today that an Irvington babysitter who stabbed her 5-year-old nephew 57 times is not guilty by reason of insanity was followed by screams of agony from the dead child's father.† (Juri, 2009) This woman will be locked up, but in a maximum security psychiatric facility not a prison. Is this just? Is this fair? It may be. What if this woman did not know that the child was what she was stabbing? What if she saw a dog that was attacking her, or maybe she was even farther removed from reality. This is the difficulty with criminal insanity cases. Sometimes, even if the person is mentally ill a murder is a murder; theft is theft. Should criminal insanity be a useable defense in Canadian court systems? Through the history there have been three basic definitions of legal insanity. First was the M'Naghten Rule. This rule stated that a person was only considered legally insane if they were "incapable of appreciating his surroundings"(Montaldo, 2010) due to a mental illness. This is a quite strict definition without much room for special cases. It caused a â€Å"black and white† view of criminal insanity cases. The M'Naghten Rule lasted until the 1950s when in the Durham v. United States case the court ruled that "would not have committed the criminal act but for the existence of a mental disease or defect."(Montaldo, 2010) the Durham method got a lot of criticism because it was very lenient on the definition of criminal insanity so that it almost depended on the judge to decide if the person was to be considered criminally insane or not. The San Bushmen of the Kalahari Desert A well-known foraging community in the southwest region of Africa is the San Bushmen. These hunting and gathering bands have lived in the Kalahari Desert region for thousands of years. The men of these communities are the primary hunters, who provide about 20 percent of the diet from the animals they kill. The women collect a various nuts, tubers, melons, and berries that provide the other 80 percent of the San diet (Nowak & Laird, 2010). The San live in one of the most marginal environments in the world and generally move around in bands when hunting or while moving around to find water or food about two to three times a week. Women can collect enough food in one day to feed their families for a full week, while men hunt two or three days a week. Vegetation is found in the same place every year, whereas animals are less reliably found in a particular location. Thus, women's knowledge about reliable locations to find food is respected and seriously considered. The rest of the time is spent in leisurely pursuits: visiting, playing, sleeping, and just enjoying each other's company (Lee, 1979). Like other foragers, have many hours of free time for leisure activities, including socializing with their kin and friends. San men vary widely in their skill at hunting, but different levels of success do not lead to differences in status. Self-deprecation and understatement are rigorously required of the hunter after a successful hunt. This modesty is evident from the moment he enters the village to relay his news. Although an energetic man might be a successful hunter, he is the â€Å"owner† of the meat only if the spear or arrow used to kill the animal was his. A man who does not excel at hunting can therefore be successful by giving an arrow he made to another hunter. If his arrow was used in the kill, he is considered the â€Å"owner† of the meat (Shostak, 1981). When looking generalized reciprocity from the outside, one would think a hunter, who chooses to share his kill among others is being very generous. However, the real reason behind this is that it enhances their survival. Without collectively sharing, the San life would be much harder. This way of life helps relieve tensions and strengthens their bonds of kinship. Reciprocity helps foragers in the way of a safety net. If a community loses a food or water source, they can ask another community to share theirs. As far as ownership is concerned, the San, have rights to waterholes, and if others want to use the waterhole, they must get permission. By sharing the use of the waterhole, the community receiving the water will reciprocate in the future with other goods or services. Other forms of ownership include tools, such as blowpipes, darts, digging sticks, and animals. Today, the San are having trouble maintaining their identity, their traditions and their cultures. The land that was once free to them is being taken away and used for game reserves and other purposes. Forcing them to move from their lands disrupts and weakens their kinship. Kinship in today’s society can go either way. It can be cohesive or disconnected due to the nature or patterns of how the relationship was built. If a child for instance had a great relationship with his/her family while growing up, they are more likely to have a great relationship throughout their lives and continue respecting their family and others. If the opposite applies, as it unfortunately happens in today’s world, they grow up to believe that they are an â€Å"island† and if they do not take care of themselves, no one else will. Modernization theory is the process of transforming from a traditional or underdeveloped society to a modern Western societies way of life. Basically, Modernization theory became the foundation stone of this evolutionary prescription for development. The theory is not homogeneous—numerous proponents disagreed on several key features. But in broad outline, the theory focused on deficiencies in the poorer countries and speculated about ways to overcome these deficiencies. It viewed traditional society as a series of negatives: stagnant and unchanging, not innovative, not profit-making, not progressing, not growing. Modernization is the economic growth within societies and the third world did not undergo these economic or political transformations; it was ‘left behind’. So the task of the Third World is to transform itself from tradition to modernity. That is, to follow the footsteps of the Western world. In fact, because the path is now charted, these countries can avoid the mistakes made by the West. On the other hand, Dependency is also not a homogeneous, unified theory—serious analytical differences persist within the school. Economic growth in advanced countries created Third World poverty in its wake: not simply that the Third World is poor in comparison with the industrialised world; rather that it is poor because development of the industrial system in Western Europe and North America changed and impoverished many societies of Asia, Africa and Latin America, through colonialism, imperialism and extractive terms of trade. When capitalism began to spread, the ceaseless search for profit began: through the production of agricultural goods in colonies or other lands, and Western Europe’s ability to drive unequal bargains. This fundamentally changed the social structures of the Third World. The term dependency comes from this link: Some say the exploitation of various regions for their raw materials and labour impoverished them and made them depend on the West. Others point out that in fact it is the other way around: that the West has been dependent on the Third World though history in order to be able to grow and prosper. Modernization theory sees capitalism as a creative force, causing growth and progress. Dependency sees international capitalism as the ruin of the Third World. Modernization sees rich countries as helpers of poor countries; dependency sees them as the main obstacle to the well-being of the poorer countries. Not all of dependency theorists’ prescriptions are anti-capitalism however: some see  some good in using capitalism and protectionism to enhance national economies. Both theories have point in terms on how develop these third world countries and address poverty. According to modernization perspective the causes of poverty are due to structural restraints placed on the third world by European powers. It describes the structural restraints as unequal exchange. The declining â€Å"terms of trade† as the price of exports from the third world are decreasing, while prices from developed countries are increasing. This effect creates a circular trap as wages in third world countries are low, which declines the export prices, while wages in richer countries a re increasing, which cause increases in the price of industrial goods. This means underdeveloped countries need to constantly increase their yields and exports for their profits to stay the same. On the other hand, dependency perspective argues that the causes of poverty in third world countries are due to their traditional cultures and values. These theories believe that in order to solve this problem poor countries can succeed through following the footsteps of developed countries. These would include invading other countries to. However, this is quite unachievable because we are now in modern time. In the case of the Philippines, I believe that we can achieve and become one of the develop countries. For example, iphone has a metal cover and iron to its internal body; the metal was produced through mining and exported to some countries. When it goes back it becomes iphone and it cost more expensive. In other words, the countries that produced metal and have limited technology are making those developed countries richer. Instead of exporting those products, utilized it within the country and profit more from it. Lack of technology is not the reason to depend in the western countries, impatient and being contented for what they have. They don’t think of the better things that they can have. The real essence of democr acy was turned off and forgot that it is the rule of the mob. If these theories are really applicable how come third world countries are still crapping and suffering from poverty.
